Traffic Fines and AARTO: Do I Really Have to Pay?

Confused by AARTO? Understand the demerit system, enforcement orders, and why ignoring fines can block your license disc renewal.

The AARTO System

The Administrative Adjudication of Road Traffic Offences (AARTO) Act changes traffic fines from criminal offenses to administrative ones. It applies mainly in Gauteng but is rolling out nationally.

The Stages of a Fine

1. Infringement Notice

You receive a fine (post or roadside). You get a 50% discount if paid within 32 days.

2. Courtesy Letter

If unpaid, you lose the discount and must pay the full amount plus fees.

3. Enforcement Order

If still ignored, an Enforcement Order is issued. This is serious.

  • You cannot renew your vehicle license disc or driving license card.
  • Demerit points are allocated to your name.

The Demerit System

Every driver starts with 0 points. Different offenses carry different points (e.g., speeding might be 2-6 points). If you exceed 15 points, your license is suspended for 3 months for every point over the limit. Three suspensions result in cancellation of your license.

Can I Ignore It?

Under the old Criminal Procedure Act system (outside AARTO areas), fines eventually turn into summonses and warrants of arrest. Under AARTO, you won't be arrested, but your administrative life becomes a nightmare (blocked licenses). Ignoring it is not a strategy.
